Are human rights being exploited to provide safety net for criminals?

Often times I have wondered when unfortunate crimes like the Delhi rape case (back in December) or the recent Mumbai rape case happen about what actually is going on in the minds of the Human rights activists who defend criminals and terrorists alike for the protection and consideration of their human rights on national television.

Under normal circumstances cheating/theft/abuse/threats or any other crime which does not seriously affect the victim (Not that a small episode doesn't, but practically speaking its about the degree of offense committed and its impact on the individual/people's life that matters here) I can still agree that giving the perpetrator a punishment term or a fine is acceptable and in some cases reasonable. But I would love to really sit someday and debate with the same people who champion human rights for such people and ask them if they have lost their sanity, as they seem to defend and fight for criminals who commit atrocious crimes that cross all levels of human consideration!

Whether its arguing that a terrorist be given a fair trial or saying that rapists need to be given due consideration on human grounds because of their age or that their sentence has to be less harsh as they seem to have come to a compromise with the victim, I feel such statements sound absurd to listen to.
To really feel the agony or pain of the victim(s), who in most of the cases is/are totally innocent and suffering and then hear these activists speak endlessly about human rights that their abusers should be provided access to, sounds like an oxymoron and such an argument is in itself injustice to the victims' dignity and existence.

And if that doesn't help our government and courts make sound judgments then maybe we should really take this statement seriously, which I read in one of the news articles about a terrorist making a statement to a fellow terrorist that read something like "He need not worry, our courts (Indian) will not hang him and that he will be ok in the jail" Wow!

The insanity of it all is that we have been such a foolish country in the past that our government and enforcement agencies don't punish such people with harsh sentences and instead allow them a hearing that shouldn't be given at all!! They are like parasites, who live on tax payers money and for committing crimes, and heinous ones at that! Wow again! So where were these people's brains or humanity when they were busy committing these crimes? Wait a minute!! Nothing in their brain signaled that what they were doing is wrong? Things which should matter to the perpetrator like human consideration to the unfortunate victim or their  dignity never struck them while they were in the heat of the moment, the same dignity or consideration which they violated so freely? The same people whom they did not give a due consideration before they blew them up, shot them, killed them or raped mercilessly? Such people need mercy? WHY?

If they weren't merciful enough, they have no right to be alive at our court's mercy either. And until and unless we realize this fact that such people need to be eliminated first from a civil society and moral judgments should be passed in order to discourage the peoples of the country from committing such crimes in future we are bound to generate more Telgi's, Yasin Bhatkals and more incidents like Mumbai rape case. And of course more attacks on our sovereignty by terrorists outside! The only way to get to a better place from here is to hope that our public and courts do not get swayed by the stupidity of being lenient on those who were not lenient on us.

Unless we prove it to our people and the people of the world that our enforcement system is strong, we will have such cases and it will happen with greater frequency. Lets not give them a chance to hide behind this delusional veil of human rights but give our citizens the right to feel safe and be protected in our home country. I am sure this is one of the reason why we fought for our freedom and I am sure one of the duties of our government in ensuring that we remain free is to protect the freedom of their citizens first, protect it by enforcing laws and handing out stricter punishments so that nobody dares to take it for granted.
